Muse Terms of Service

California purchasers: You may cancel a purchase, without penalty or obligation, at any time prior to midnight of the third business day following the date of purchase. If you purchased using your Apple ID, refunds are handled by Apple, not Muse. You can request a refund from Apple through your Apple ID account on your phone or at https://getsupport.apple.com.
In accordance with Cal. Civ. Code §1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at Consumer Information Division, 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
1. Acceptance of Terms
Welcome to Muse ("we," "our," or "us"). Muse is a social music app for discovering people through music and connecting at live music events. By downloading, accessing, or using the Muse mobile application or App Clip (together, the "App"), or our websites at museapp.co including the event organizer portal (the "Sites"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or the Sites.
These Terms constitute a legally binding agreement between you and Muse Labs Inc. We may update these Terms from time to time, and your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
2. Eligibility
To use Muse, you must:
- Be at least 18 years of age
- Be legally able to enter into a binding contract
- Not be prohibited from using the App under applicable law
- Not have been previously banned or removed from Muse
By using Muse, you represent and warrant that you meet all eligibility requirements. You can gain access to Muse by redeeming an invite code, verifying an email from a U.S. college or university (a .edu email), or attending a participating live event. College enrollment is not required to use Muse; every entry path requires you to be at least 18 years of age.
3. Account Registration
- Sign-In: You create a full account by signing in with Apple. You are responsible for maintaining the security of your Apple ID and Muse account.
- Anonymous Event Access: If you scan an event QR code using the Muse App Clip, we create an anonymous account so you can check in and post to the event's photo wall before signing up. If you later install the full App on the same device, your anonymous account and its activity are carried over to your account.
- One Account Per Person: You may only create and maintain one Muse account. Creating multiple accounts may result in permanent suspension.
- Accurate Information: You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.
- Account Security: You are responsible for all activity that occurs under your account. Notify us immediately at support@museapp.co if you suspect unauthorized access.
4. User Conduct
You agree not to:
- Harass, bully, stalk, intimidate, threaten, or defame any person
- Create a fake or misleading profile, or impersonate any person or entity
- Post or share content that is illegal, obscene, hateful, discriminatory, or promotes violence
- Send spam, unsolicited messages, or commercial solicitations
- Use the App for any illegal purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to other users' accounts or our systems
- Use automated scripts, bots, or scrapers to access or interact with the App
- Interfere with or disrupt the App's functionality or servers
- Share content depicting minors or any form of child exploitation
- Solicit money, goods, or services from other users
- Advertise, solicit, or promote commercial sexual services or engage in sex trafficking or human trafficking of any kind
Violation of these rules may result in immediate account suspension or permanent termination, at our sole discretion.
5. User-Generated Content
5.1 Your Content
You retain ownership of all content you post on Muse, including photos, event-wall selfies, captions, text, biography, prompt responses, and messages ("Your Content"). By posting content on Muse, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, display, reproduce, and distribute Your Content solely for the purpose of operating and providing the Muse service.
5.2 Content Standards
Your Content must not:
- Contain nudity, sexually explicit material, or graphic violence
- Infringe on any third party's intellectual property rights
- Contain personal information of others without their consent
- Be deceptive, fraudulent, or misleading
5.3 Content Moderation
We reserve the right to review, remove, or disable access to any content that violates these Terms or our Community Guidelines, without prior notice. Photos posted to event walls are additionally screened by an automated image-classification system before they appear; content that fails this screening is rejected. Users can report content or other users directly through the App.
5.4 Zero Tolerance for Objectionable Content and Abusive Behavior
Muse has zero tolerance for objectionable content and abusive users. Content that is offensive, harassing, threatening, hateful, sexually explicit, or otherwise objectionable is prohibited, as is harassing, abusing, or threatening other users. You agree to this by using Muse. We will act on reports of objectionable content or abusive behavior — including removing the content and suspending or terminating the responsible account — and we aim to do so within 24 hours of a report. You can report content or block any user directly in the App at any time.
5.5 Events & Photo Walls
Muse runs experiences at live music events. To take part, you scan an event QR code and confirm you are at the venue. You may post front-camera selfies (with optional captions) to the event's photo wall, where they are visible to other attendees viewing that event — not only to your matches. You are responsible for the photos you post and must have the right to share them. You can delete a photo you posted at any time, and you may report or request removal of others' content through the App.
6. Music Data & Spotify Integration
Muse integrates with Spotify to provide music-based features. By connecting your Spotify account:
- You authorize Muse to access playback state data when you play music through Spotify while using the App
- Muse does not store your Spotify credentials (username or password)
- Muse does not access your Spotify listening history, saved playlists, or library data outside of active playback within the App
- Spotify integration is optional; you can use Muse without connecting Spotify
- You can disconnect Spotify at any time, and Spotify connection is managed automatically by the App
Your use of Spotify is also governed by Spotify's Terms of Use and Privacy Policy.
7. In-App Purchases
Muse offers optional consumable in-app purchases:
- Peeks: A consumable purchase that reveals the profile of someone who has liked you. Peeks are sold in bundles, and unused Peeks carry over until you use them.
- Spotlights: A consumable purchase that temporarily increases your profile's visibility in discovery.
Muse does not offer subscriptions. No purchase is required to use Muse: you can discover, match, and message without paying anything.
7.1 Payment & Billing
- All purchases are processed through Apple's App Store. By making a purchase, you agree to Apple's Terms and Conditions.
- Pricing is displayed in the App before you confirm a purchase. Prices may change at any time; changes apply only to future purchases.
7.2 Refunds
- All purchases are final and non-refundable, except where a refund is required by applicable law or granted by Apple under its policies.
- Refunds are handled by Apple, not Muse. Refund requests must be submitted to Apple directly through reportaproblem.apple.com.
- Peeks and Spotlights have no cash value, cannot be transferred or exchanged, and any unused balance is forfeited if you delete your account or your account is terminated for violating these Terms.
8. Matching & Communication
- No Guarantee of Matches: Muse does not guarantee that you will receive matches, likes, or messages. Matching depends on mutual interest and the availability of other users near you.
- Discovery: Discovery and matching are based on factors such as distance and your preferences. Available features may vary by location and change over time.
- Moderation: We reserve the right to moderate messages and content to maintain a safe environment. We may review reported conversations and take action against users who violate these Terms.
- Blocking & Reporting: You can block or report any user at any time. Blocking a matched user will unmatch you and prevent further communication.
9. Safety & Interactions with Other Users
Muse does not conduct criminal background checks and does not verify the identity of its users. Muse does not offer photo verification or government ID verification. Members join through an invite code, a verified email from a U.S. college or university (a .edu email), a check in at a live event, or an application reviewed by our team. These membership gates limit who can create an account; they do not confirm anyone's identity, background, or intentions. Verifying a college email confirms control of that email address only. A verification badge on a profile means only that the person joined by verifying a U.S. college or university email; it does not mean we have confirmed who they are. Approval of an application is not an endorsement of that person. We make no representations or warranties about the conduct, identity, or intentions of any user.
You are solely responsible for your interactions with other users, both within the App and in person, including at live events. Muse is not responsible for the conduct of any user, online or offline.
Use good judgment when connecting with people you meet on Muse:
- Get to know someone in the App before meeting in person
- Meet in a public place and tell a friend where you are going
- Arrange your own transportation to and from a first meeting
- Never send money or share financial information with another user (soliciting money also violates Section 4)
- Report anyone who behaves inappropriately using the reporting tools in the App
10. Privacy
Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Muse, you consent to the data practices described in the Privacy Policy.
11. Account Deletion
You can delete your account at any time from Settings → Account → Delete Account within the App. When you delete your account:
- Your profile is immediately removed from discovery and matching
- Your personal data, profile pictures, event-wall selfies, messages, and matches are permanently deleted
- Any unused in-app purchases (such as Peeks) are forfeited and are not refunded
- Account deletion is irreversible; you cannot recover a deleted account
If your account has been reported for violating these Terms, or if content you submitted was blocked or flagged by our automated moderation, we may retain certain information as described in our Privacy Policy for safety and moderation purposes. Those records can be kept after your account is deleted.
12. Intellectual Property
- The Muse name, logo, brand identity, and all associated trademarks are the property of Muse Labs Inc.
- The App's design, features, code, and content (excluding User Content) are protected by copyright, trademark, and other intellectual property laws.
- You may not copy, modify, distribute, sell, or lease any part of the App or its content without our express written permission.
- You may not use the Muse brand or trademarks in any way that suggests endorsement or affiliation without our prior written consent.
12.1 Copyright Complaints (DMCA)
Muse respects the intellectual property rights of others and expects users to do the same. If you believe content on Muse infringes your copyright, send a notice to our designated copyright agent at support@museapp.co with the subject line "DMCA Notice". Your notice must include, consistent with 17 U.S.C. §512(c)(3):
- Identification of the copyrighted work you claim is infringed
- Identification of the material you claim is infringing, with enough detail for us to locate it (for example, the profile or event wall where it appears)
- Your name, mailing address, telephone number, and email address
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
- Your physical or electronic signature
We will remove or disable access to material identified in a valid notice. If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice to the same address containing the information required by 17 U.S.C. §512(g)(3). We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.
13. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- Any defects will be corrected
- The App is free of viruses or harmful components
- The results obtained from use of the App will be accurate or reliable
- Any user is who they claim to be, or that any user will comply with these Terms, online or offline
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUSE LABS INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use of or inability to use the App
- Any conduct or content of any other user of the App
- Unauthorized access, use, or alteration of your content or data
- Any interactions with other users, whether online or offline
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO MUSE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE EXCLUSIONS AND LIMITATIONS IN SECTIONS 13 AND 14 MAY NOT APPLY TO YOU. IN THAT CASE, OUR WARRANTIES AND LIABILITY ARE EXCLUDED AND LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND THE REMAINING PROVISIONS REMAIN IN FULL FORCE AND EFFECT.
15. Indemnification
You agree to indemnify, defend, and hold harmless Muse Labs Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of a third party.
16. Termination
- We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable.
- We may also terminate accounts that have been inactive for an extended period.
- Upon termination, your right to use the App ceases immediately, and we may delete your account data in accordance with our Privacy Policy.
- Sections of these Terms that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law & Dispute Resolution) shall survive.
17. Changes to Terms
We may revise these Terms from time to time. When we make material changes, we will:
- Update the "Last Updated" date at the top of these Terms
- Notify you through the App or via email for significant changes
- Request your consent if required by applicable law
Your continued use of Muse after the revised Terms are posted constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App and delete your account.
18. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association. Either party may instead bring an individual claim in small claims court if the claim qualifies for that court.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Your right to opt out of arbitration: You may opt out of this agreement to arbitrate by emailing support@museapp.co within 30 days of the date you first accept these Terms. Your email must include your name, the email address associated with your Muse account, and a clear statement that you want to opt out of arbitration. Opting out of arbitration does not affect any other provision of these Terms.
Time limit on claims: To the extent permitted by applicable law, any claim arising out of or relating to these Terms or your use of the App must be filed within one (1) year after the claim arose. Claims not filed within that period are permanently barred.
19. Business & Organizer Terms
If you create an organizer account on our Sites to run Muse experiences at your events, the following additional terms apply to you and the organization you represent:
- Authority: You represent that you are authorized to act on behalf of your organization and to bind it to these Terms.
- Accurate Information: You agree to provide accurate business and event information, and to hold events at the venues and times you list.
- Attendee Data: Any event information, statistics, or attendee-related data made available through the organizer portal may be used only to operate your event and may not be sold, shared with third parties, or used to contact attendees outside of Muse. You may not attempt to identify, re-identify, or build profiles of individual attendees.
- Your Events: You are solely responsible for your events, including venue safety, permits, licensing, and compliance with applicable law. Muse provides software for event experiences; Muse does not organize, host, sponsor, or supervise your events and is not responsible for anything that occurs at them.
- Content: Materials you upload (event names, posters, venue details) must be accurate and must not infringe any third party's rights.
- Termination: We may suspend or close organizer accounts that violate these Terms or misuse attendee data.
All other provisions of these Terms, including the Disclaimers, Limitation of Liability, Indemnification, and Governing Law & Dispute Resolution sections, apply to organizer accounts and to your use of the Sites.
20. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Muse regarding your use of the App and the Sites.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- Assignment: We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
